Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you", "user", "player") and the operator of Merlis ("we", "us", "Merlis") regarding your access to and use of the Merlis game, the website at merlis.eu, and any related services (together, the "Service"). By creating an account or using the Service, you confirm that you have read, understood and accepted these Terms and our Privacy Policy.
1. Eligibility
You must be at least 16 years old (or the age of digital consent in your country, if higher) to use the Service. By registering, you represent that you meet this requirement and that the information you provide is accurate and complete. If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian's permission.
2. Account Registration
- You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.
- You may not share, sell, transfer or trade your account.
- You must immediately notify us of any unauthorised access or security breach.
- We may refuse, suspend or terminate accounts that violate these Terms or that we reasonably believe are used for fraudulent or harmful purposes.
3. License to Use the Service
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for non-commercial entertainment purposes. All intellectual property rights in the Service, including the game client, server software, graphics, sounds, characters, items and trademarks, remain the property of Merlis or its licensors.
4. User Conduct
You agree not to:
- use cheats, bots, hacks, exploits, automation tools, third-party software or any unauthorised modification of the game client;
- reverse engineer, decompile or attempt to extract the source code of the Service except to the extent permitted by law;
- disrupt, overload, attack or interfere with the Service or its infrastructure;
- harvest, scrape or otherwise collect data about other users;
- impersonate any person, harass, threaten or abuse other users;
- upload, post or share illegal, defamatory, obscene, hateful or infringing content;
- use the Service to violate any applicable law or third-party right;
- engage in real-money trading of in-game items, currency or accounts outside the channels we explicitly authorise.
5. Virtual Items & Purchases
- In-game currency and virtual items have no monetary value, cannot be exchanged for real money outside the Service, and remain our property at all times.
- You receive a limited, personal, revocable license to use them within the Service.
- Prices, availability and contents of virtual items may change at any time.
- By purchasing digital content, you expressly agree that performance begins immediately upon purchase and that you waive any statutory right of withdrawal under EU consumer law that would otherwise apply once delivery has begun (Directive 2011/83/EU, Art. 16(m)).
- All sales of digital access are final. Refunds, if any, are granted at our sole discretion in line with our Refund Policy.
6. Communications
By creating an account, you agree that we may send you transactional emails (account confirmations, password resets, security alerts, payment receipts, important Service updates) which are necessary for the operation of your account and cannot be opted out of while your account remains active. Marketing communications are sent only with your separate, explicit opt-in consent and can be withdrawn at any time, as described in our Privacy Policy.
7. Suspension & Termination
We may suspend, restrict or terminate your account at any time, with or without notice, if we reasonably believe that you have violated these Terms, our anti-cheat policy, or applicable law. You may close your account at any time by contacting us. Termination of your account does not entitle you to a refund of unused virtual currency or items, except where required by mandatory law.
8. Disclaimer of Warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement and availability. We do not warrant that the Service will be uninterrupted, error-free, secure or free from viruses or other harmful components. Mandatory consumer-protection rights under EU and national law remain unaffected.
9. Limitation of Liability
To the maximum extent permitted by law, Merlis shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or in-game progress, arising out of or in connection with your use of the Service. Nothing in these Terms excludes our liability for damages caused by gross negligence or wilful misconduct, or for personal injury or death caused by our negligence, or any other liability that cannot be excluded by law.
10. Indemnity
You agree to indemnify and hold harmless Merlis, its operators, staff, agents and partners against any claims, damages, losses or expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Service, except to the extent such claims result from our own fault.
11. Changes to the Service or Terms
We may modify, suspend or discontinue all or part of the Service at any time. We may also update these Terms from time to time. Material changes will be notified through the Service or by email at least 14 days before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and may close your account.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye, without prejudice to the mandatory consumer-protection rules of the country in which you have your habitual residence within the EU. Disputes shall be brought before the competent courts of Türkiye, except where mandatory law gives consumers the right to bring proceedings in their place of residence.
13. Online Dispute Resolution
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obliged and not willing to take part in dispute settlement proceedings before a consumer arbitration board.
14. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be replaced with one that most closely reflects the original intent.
